Compost and Digestate Market Bill (SB1397) and Food Recovery and Diversion Bill (HB1707/SB1398)

Updates on HB1707/SB1398 and Next Steps

First, we would like to extend a huge thank you to all of you for the truly impressive groundswell of enthusiasm and support for the first year of the Feed and Conserve IL movement. We are officially only a few months old, and in those few months, we have grown our supporters to over 50 organizations and thousands of individuals. We cleared our first hurdle in these bills becoming law by passing out of the House Energy and Environment Committee with over 550 witness slips in support. We are so proud of what we accomplished together in just a short time.

Negotiations around HB1707/SB1398 (the bills are identical) are ongoing. Unfortunately, they will not be finalized in time to meet the April 11th deadline for a vote by the General Assembly. The timeframe was too short for the bill to progress further this session, considering the number of stakeholders involved. For the remainder of this year, leading up to the 2026 legislative session, Feed and Conserve Illinois will continue to strengthen our grassroots movement, refine the legislation, and build greater support to achieve our goal of feeding people and conserving Illinois. Our sponsors, Senator Adriane Johnson and Representative Joyce Mason, remain fully committed to advancing these bills, and discussions about potential amendments are ongoing.

We ask that you continue to stay engaged and active on this important issue. Please spread the word about Feed and Conserve Illinois! If you haven’t already, reach out to your legislators this spring and summer to ask them to support and co-sponsor HB1707/SB1398. Your continued advocacy is critical in demonstrating strong public backing for these bills and makes them a priority in the legislative process.

Senator Adriane Johnson has introduced two companion bills to strengthen food scrap diversion and compost market development in Illinois. The Compost and Digestate Market Development Bill (SB1397) creates a grant program to expand and study compost and digestate use. The Food Recovery and Diversion Bill (HB1707/SB1398) establishes a clear path for food scrap diversion from landfills.

"SB 1398 is critical legislation that will help Illinois transition to a more sustainable and circular food system by reducing methane emissions, increasing food diversion, and fostering economic growth. Food waste is not just an environmental issue—it’s an economic and climate imperative. Landfills are the third-largest source of methane emissions in the U.S., with food waste responsible for 58% of those emissions. 
"Beyond climate benefits, this bill will create new economic opportunities by expanding markets for surplus food. By phasing in food scrap diversion requirements and supporting infrastructure development, SB 1398 ensures that businesses, municipalities, and food service providers have the resources needed to participate in a growing circular economy. This policy will drive job creation, reduce landfill dependency, and strengthen local food systems—all while making Illinois a leader in food waste reduction.”
